  1. NETSCAPE CHAT END USER LICENSE AGREEMENT 
  2. NO FEE VERSION 
  3. REDISTRIBUTION NOT PERMITTED 
  4.  
  5. Beta 1 of version 0.9 of the Netscape Chat will 
  6. expire on August 15, 1995 and you will not be able to 
  7. use it after that date. 
  8.  
  9. GRANT. Netscape Communications Corporation ("Netscape") 
  10. hereby grants you a non-exclusive license to use its 
  11. accompanying software product ("Software") free of charge if 
  12. (a) you are a student, faculty member or staff member of an 
  13. educational institution (K-12, junior college or college) or 
  14. an employee of a charitable non-profit organization; or (b) 
  15. your use of the Software is for the purpose of  evaluating 
  16. whether to purchase an ongoing license to the Software.  The 
  17. evaluation period for use by or on behalf of a commercial 
  18. entity is limited to 90 days; evaluation use by others is not 
  19. subject to this restriction.  Government agencies are not 
  20. considered charitable non-profit organizations for purposes 
  21. of this license agreement.  If you do not fit within the 
  22. description above, a license fee is due to Netscape and no 
  23. license is granted. If you are using the Software free of 
  24. charge, you will not be entitled to support or telephone 
  25. assistance.

  27. If you fit within the above description, you may: use the 
  28. Software on any single computer; use the Software on a second 
  29. computer so long as the first and second computers are not 
  30. used simultaneously; or copy the Software for archival 
  31. purposes, provided any copy must contain all of the original 
  32. Software's proprietary notices. 
  33.  
  34. You may not: permit other individuals to use the Software 
  35. except under the terms listed above; modify, translate, 
  36. reverse engineer, decompile, disassemble (except to the 
  37. extent applicable laws specifically prohibit such 
  38. restriction), or create derivative works based on the 
  39. Software; copy the Software (except for back-up purposes); 
  40. rent, lease, transfer or otherwise transfer rights to the 
  41. Software; or remove any proprietary  notices or labels on the 
  42. Software.

  44. SOFTWARE. If you receive your first copy of the Software 
  45. electronically, and a second copy on media, the second copy 
  46. may be used for archival purposes only.  This license does 
  47. not grant you any right to any enhancement or update. 
  48.  
  49. TITLE. Title, ownership rights, and intellectual property 
  50. rights in and to the Software shall remain in Netscape and/or 
  51. its suppliers. The Software is protected by the copyright 
  52. laws of the United States and international copyright 
  53. treaties.  Title, ownership rights, and intellectual property 
  54. rights in and to the content accessed through the Software is 
  55. the property of the applicable content owner and may be 
  56. protected by applicable copyright or other law. This License 
  57. gives you no rights to such content. 
  58.  
  59. DISCLAIMER OF WARRANTY. Since the Software is provided free 
  60. of charge, the Software is provided on an "AS IS" basis, 
  61. without warranty of any kind, including without limitation 
  62. the warranties of merchantability, fitness for a particular 
  63. purpose and non-infringement. The entire risk as to the 
  64. quality and performance of the Software is borne by you. 
  65. Should the Software prove defective, you and not Netscape 
  66. assume the entire cost of any service and repair. In 
  67. addition, the security mechanism implemented by the Software 
  68. has inherent limitations, and you must determine that the 
  69. Software sufficiently meets your requirements.  This 
  70. disclaimer of warranty constitutes an essential part of the 
  71. agreement. SOME STATES DO NOT ALLOW EXCLUSIONS OF AN IMPLIED 
  72. WARRANTY, SO THIS DISCLAIMER MAY NOT APPLY TO YOU AND YOU MAY 
  73. HAVE OTHER LEGAL RIGHTS THAT VARY FROM STATE TO STATE OR BY 
  74. JURISDICTION.

  76. LIMITATION OF LIABILITY. UNDER NO CIRCUMSTANCES AND UNDER NO 
  77. LEGAL THEORY, TORT, CONTRACT, OR OTHERWISE, SHALL NETSCAPE OR 
  78. ITS SUPPLIERS OR RESELLERS BE LIABLE TO YOU OR ANY OTHER 
  79. PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR 
  80. CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT 
  81. LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, 
  82. COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER 
  83. COMMERCIAL DAMAGES OR LOSSES. IN NO EVENT WILL NETSCAPE BE 
  84. LIABLE FOR ANY DAMAGES IN EXCESS OF NETSCAPE'S LIST PRICE FOR 
  85. A LICENSE TO THE SOFTWARE, EVEN IF NETSCAPE SHALL HAVE BEEN 
  86. INFORMED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM 
  87. BY ANY OTHER PARTY. THIS LIMITATION OF LIABILITY SHALL NOT 
  88. APPLY TO LIABILITY FOR DEATH OR PERSONAL INJURY TO THE EXTENT 
  89. APPLICABLE LAW PROHIBITS SUCH LIMITATION. FURTHERMORE, SOME 
  90. STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL 
  91. OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION AND EXCLUSION 
  92. MAY NOT APPLY TO YOU. 
  93.  
  94. TERMINATION.  This license will terminate automatically if 
  95. you fail to comply with the limitations described above.  On 
  96. termination, you must destroy all copies of the Software. 
  97.  
  98. EXPORT CONTROLS.  None of the Software or underlying 
  99. information or technology may be downloaded or otherwise 
  100. exported or reexported (i) into (or to a national or resident 
  101. of) Cuba, Iraq, Libya, Yugoslavia, North Korea, Iran, Syria 
  102. or any other country to which the U.S. has embargoed goods; 
  103. or (ii) to anyone on the U.S. Treasury Department's list of 
  104. Specially Designated Nationals or the U.S.  Commerce 
  105. Department's Table of Deny Orders. By downloading  or using 
  106. the Software, you are agreeing to the foregoing and you are 
  107. representing and warranting that you are not located in, 
  108. under the control of, or a national or resident of any such 
  109. country or on any such list. 
  110.  
  111. MISCELLANEOUS. This Agreement represents the complete 
  112. agreement concerning this license between the parties and 
  113. supersedes all prior agreements and representations between 
  114. them. It may be amended only by a writing executed by both 
  115. parties. If any provision of this Agreement is held to be 
  116. unenforceable for any reason, such provision shall be 
  117. reformed only to the extent necessary to make it 
  118. enforceable.  This Agreement shall be governed by and 
  119. construed under California law as such law applies to 
  120. agreements between California residents entered into and to 
  121. be performed within California, except as governed by Federal 
  122. law. The application the United Nations Convention of 
  123. Contracts for the International Sale of Goods is expressly 
  124. excluded.

  126. U.S. Government Restricted Rights.  Use, duplication or 
  127. disclosure by the Government is subject to restrictions set 
  128. forth in subparagraphs (a) through (d) of the Commercial 
  129. Computer-Restricted Rights clause at FAR 52.227-19 when 
  130. applicable, or in subparagraph (c)(1)(ii) of the Rights in 
  131. Technical Data and Computer Software clause at DFARS 
  132. 252.227-7013, and in similar clauses in the NASA FAR 
  133. Supplement.  Contractor/manufacturer is Netscape
